Salary Range:
$150,000 - no experience required.
$175,000 - 3+ years of experience as an Attorney, no Personal Injury experience required.
$200,000 - 5+ years of experience as an Attorney and Personal Injury experience is required, and the ability to manage a GGRM caseload independently.
Position Summary:
The Arbitration Attorney is responsible for exclusively managing cases from initial intake through final arbitration resolution. The Arbitration Attorney serves as the primary point of contact on assigned cases, leading negotiations, comprehensive medical management, and representing clients in mediations and arbitrations. Success in this role relies on strong legal judgment, attention to detail, and the ability to resolve cases efficiently while delivering exceptional client service.
Essential Duties and Responsibilities:
The essential functions include, but are not limited to, the following:?
Processing assigned claims in accordance with Firm policies and procedures.
Ensuring case management software (CMS) feed is cleared daily.
Completing all assigned tasks by relevant deadlines.
Documenting all relevant activity in CMS properly.
Ensuring emails are cleared daily.
Leading early case evaluation by completing initial 72-hour client contacts, assessing cases for immediate demand potential, and identifying those requiring specialized expertise.
Reviewing and analyzing medical records for red flags, lifecare planning needs, and potential liability or damages issues.
Monitoring statute of limitations deadlines and directing initial investigation and evidence-gathering strategies.
Developing comprehensive case valuations and reviewing or editing settlement demands for partner approval.
Maintaining active case management by communicating efficiently with Claims Specialists, monitoring progress and deadlines, and overseeing the collection of medical records and lien resolution.
Completing Quarterly Meaningful Client Contacts and managing client expectations through proactive communication and timely resolution of complex concerns.
Managing court-annexed arbitration cases from initial pleadings through hearings, including discovery, expert witness coordination, and evidence preparation.
Developing and executing arbitration-specific strategies tailored to case value and forum requirements.
Collaborating with Litigation Specialists to ensure arbitration deadlines are met and case files are complete and presentation ready.
Conducting pre-arbitration conferences with clients and experts to align strategy, testimony, and expectations.
Presenting cases at arbitration and handling post-arbitration matters such as appeals and enforcement of awards.
Analyzing arbitration outcomes and incorporating feedback to improve future case handling and resolution strategies.
Leading settlement negotiations by developing strategies, preparing and reviewing demands, and evaluating settlement offers.
Drafting and reviewing releases, approving disbursements, managing medical lien negotiations, and directing reduction requests.
Preparing necessary correspondence, including Poremba and Breen letters, to support final resolution.
Conducting regular meetings with Claims Specialists to ensure alignment and effective case handling.
Participating in litigation transfer meetings to ensure a smooth hand-off.
Coordinating with Investigation Specialists to facilitate smooth case transitions.
Participating in staff meetings and leadership team meetings.
Performing other duties as assigned.
Requirements:
Required Qualifications:
Graduate of an accredited institution by the American Bar Association with a Juris Doctor degree and a specialization in law or any related field
Licensed to practice law in the State of Nevada and in good standing with the Nevada State Bar
A valid Nevada driver's license, valid driver's insurance, and proof of driving record
Thorough knowledge of legal principles, legal research techniques, legal terminology, and government regulations
Excellent legal drafting, writing, and verbal communication skills
Prefered Qualifications
Minimum of two years of experience in Personal injury
Proven settlement negotiation track record
Bilingual in English and Spanish
Experience managing legal teams
